Agreement to these terms
These Terms and Conditions (“Terms”) apply to your use of cassidyshaver.com and to services provided by Cassidy Shaver Consulting unless a separate written agreement says otherwise. By purchasing, requesting, or using our services, you agree to these Terms.
Services
Cassidy Shaver Consulting provides website design, website setup, website hosting/maintenance coordination, client portal tools, website copy support, image selection/optimization support, booking/contact form setup, automated email setup, dashboard configuration, consulting, and related services for small businesses.
Specific deliverables, timelines, and features depend on the package purchased, the client’s submitted information, the platform capabilities available at the time, and any written scope agreed between the parties.
Payments, subscriptions, and billing
- Startup/setup fees are due before project work begins unless otherwise agreed in writing.
- The current public promotion is a $249 startup fee through June 30, 2026. The normal startup fee is $499 unless otherwise stated in writing.
- The standard monthly website plan is $99/month after the first 30 days from initial payment unless otherwise agreed.
- Monthly subscriptions cover hosting/maintenance support, dashboard access where applicable, automated email/form support where applicable, and up to 1 hour/month of eligible small change requests.
- Additional work, rush work, custom features, ecommerce/payment setup, large content changes, third-party costs, premium tools, domains, ads, stock assets, or work beyond the included monthly allowance may require a separate quote.
Client responsibilities and project timing
Project timelines depend on the client providing the required information, approvals, credentials, access, photos, service/product details, policies, payment/shipping/tax information, and other materials needed to complete the work. We can only complete work within a reasonable time after the client provides the required information.
If a client delays, does not respond, changes direction, withholds required access, or provides incomplete/inaccurate information, project timelines may be extended and launch dates are not guaranteed.
No-refund policy after work begins
Startup/setup fees are non-refundable once work has commenced. Work commencement includes, but is not limited to, creating a client’s auth account or portal access, creating initial Supabase/project/site rows, creating client portal onboarding records, creating intake/action items, planning the site structure, reviewing client information, starting copy/design work, configuring forms/emails, creating demo or staging work, or otherwise beginning setup or implementation.
This policy does not limit any rights that cannot be waived under applicable law.
Dashboard access and self-service changes
Where dashboard features are available, clients may be able to update supported parts of their site, such as certain services, programs, offerings, pricing notes, availability, team members, photos, announcements, policies, or other structured fields. Dashboard access does not guarantee every site element is self-service editable.
Some edits may require a change request, admin review, custom quote, or development work. We may limit or correct changes that break layout, violate platform rules, create security risk, or conflict with the purchased package.
Change requests and monthly maintenance
The standard monthly plan includes up to 1 hour/month of eligible small change requests. Unused time does not roll over unless specifically agreed. Larger, complex, custom, urgent, or unsupported requests may require a separate quote or rush fee.
Examples of small requests may include simple text edits, swapping images, updating services/programs, minor policy copy updates, basic page content updates, or similar supported changes. Examples of larger requests include new custom functionality, major redesigns, large content migrations, new payment/commerce flows, custom integrations, complex forms, or changes requiring significant testing.
Third-party platforms and accounts
Services may depend on third-party platforms such as Cloudflare, Supabase, Stripe, Postmark, Google, domain registrars, email providers, and other tools. We are not responsible for outages, policy changes, pricing changes, account restrictions, verification requirements, or service failures caused by third-party platforms.
Clients are responsible for maintaining access to accounts they own and for complying with third-party terms.
Payments, taxes, shipping, refunds, and fulfillment for client sites
If a client website accepts payments, the client business remains responsible for its own taxes, tax registrations, tax filings, shipping rules, fulfillment, refunds, returns, damaged/lost package policies, customer service, business licensing, and legal compliance. Cassidy Shaver Consulting does not provide legal, accounting, tax, shipping, insurance, or financial advice.
Payment features may use Stripe and may require the client to connect and maintain its own Stripe account. Payment-enabled features are only available when configured, tested, and approved for the specific site.
No guarantees
We work to provide professional, useful, conversion-focused websites and consulting. However, we do not guarantee specific search rankings, traffic, sales, leads, bookings, revenue, social media growth, advertising results, or business outcomes.
Client content and approvals
Clients are responsible for the accuracy, legality, and ownership rights of content, photos, logos, product/service information, claims, prices, policies, testimonials, and other materials they provide or approve for publication. By providing materials, the client represents that they have the right to use them.
Intellectual property
Unless otherwise agreed, Cassidy Shaver Consulting retains ownership of reusable platform code, templates, systems, processes, components, design patterns, internal tools, and generalized know-how. Clients receive a license to use the configured website for their business while their account is active and in good standing.
Client-owned trademarks, logos, original business content, and client-provided materials remain the client’s property.
Termination and suspension
We may suspend or terminate services for nonpayment, misuse, security risk, abusive behavior, unlawful content, violation of these Terms, or operational reasons. Upon cancellation or nonpayment, hosting, forms, dashboard access, automated emails, booking flows, and other services may stop working.
Limitation of liability
To the fullest extent permitted by law, Cassidy Shaver Consulting is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost revenue; lost data; business interruption; third-party platform failures; or damages beyond the amount paid to us for the service giving rise to the claim.
Governing law
These Terms are intended to be governed by the laws of Texas, except where applicable law requires otherwise.
